These Terms and Conditions of Sale (hereinafter T&Cs) govern the contractual relationship between Atelier Mickaël Amant (hereinafter the Seller) and any person wishing to purchase handcrafted rainsticks, bamboo rainsticks or other artisan musical instruments (hereinafter the Customer) on the website https://arbredepluie.com

1. Acceptance of the T&Cs
By using the site or placing an order, the Customer fully accepts these T&Cs and the Privacy Policy without restriction. Before confirming an order, the Customer must check the box “I have read and accept the Terms and Conditions of Sale and the Privacy Policy.”
2. Independence of clauses
If any clause of these T&Cs is declared invalid, the remaining clauses shall remain fully applicable.
3. Modification of the T&Cs
The Seller reserves the right to modify these T&Cs at any time. Updated T&Cs take effect as soon as they are published on the website and apply to all subsequent orders.
4. Intellectual property
All content on the website (logos, texts, images, product descriptions, videos, designs, photographs of rainsticks and other handcrafted instruments) is protected by copyright and intellectual property law. Any reproduction, in whole or in part, without prior written consent from Atelier Mickaël Amant is strictly prohibited.
5. Product availability
Product offers are valid as long as they are visible on the website, subject to stock availability. Most of our artisan rainsticks and sound instruments are handcrafted to order, and specific production lead times are indicated on each product page. Product descriptions are provided for information purposes only and have no contractual value.
6. Prices and shipping costs
Prices are indicated in euros (€), inclusive of all taxes, but excluding delivery charges. Delivery fees are added to the total amount and are specified before order confirmation. The Seller reserves the right to change prices at any time, but products will be invoiced at the price in effect at the time of order validation. In case of a pricing error, the Seller may correct it and inform the Customer, who can either accept the new price or cancel the order.
7. Delivery and lead times
Subject to availability, delivery will take place within a maximum of 30 days from order confirmation.

International delivery: generally over 10 days
For any order above €400 (VAT included), delivered in mainland France, shipping costs are free of charge.
In case of delivery issues (damaged parcel, broken product, detuned instrument), the Customer must note written reservations on the delivery slip and confirm them by registered mail within 48 hours.
8. Payment methods

Full payment is required before delivery.
9. Formation of the contract
The sales contract is considered formed when the Customer receives an order confirmation email. The Customer certifies being at least 18 years of age and legally able to contract.
10. Order refusal
The Seller reserves the right to refuse or cancel any order in case of previous disputes or suspected fraud.
11. Transfer of ownership and risk
Products remain the property of Atelier Mickaël Amant until full payment has been received. Transfer of risks occurs upon delivery of the products to the Customer.
12. Legal warranty of conformity
The Customer benefits from the legal warranty of conformity as provided under French Consumer Law. In case of a non-compliant or defective product, the Customer may request an exchange or a refund.
13. Hidden defects
In accordance with Articles 1641 and following of the French Civil Code, Atelier Mickaël Amant is liable for hidden defects that render the product unfit for its intended use.
14. Right of withdrawal
In accordance with Article L.121-21 of the French Consumer Code, the Customer has a period of 14 days to withdraw without justification. Products must be returned in their original packaging, complete and in perfect condition.
15. Exercising the right of withdrawal
The Customer must notify the Seller in writing (by email or postal mail). Return shipping costs are the responsibility of the Customer. Refunds will be processed within a maximum of 15 working days after receipt and inspection of the returned product.
16. Force majeure
The Seller cannot be held liable for delays or non-performance in case of force majeure (strikes, floods, fires, network failures, cyberattacks, etc.).

18. Mediation and dispute resolution

19. Applicable law and jurisdiction
These T&Cs are subject to French law. Any dispute will be submitted to the competent courts of Montpellier, France.

Data collected through the site arbredepluie.com is used for order processing and to personalize the customer experience (newsletters, special offers). Data is processed in compliance with GDPR.
